Lost original bills of lading. What do I do?

The Original Bill of Lading (B/L) issued to you is a very important legal document, evidencing the carrier’s receipt of the goods, the terms of the contract of carriage and your right to possession of the goods.

Swire Shipping’s standard procedure for the delivery of cargo is:

Cargo should only be released to a Consignee upon presentation of an endorsed Original Bill of Lading at the port of discharge listed on the B/L, or surrender of the full set of Original B/L’s at an alternate Swire Shipping port office or Swire Shipping agent’s office, as mutually agreed.

If the Original Bill of Lading has been lost or destroyed consideration may be given, by Swire Shipping, to the release of the cargo without presentation of an Original B/L if one of the following documents are provided;

  • A Letter of Indemnity (LOI) signed for and on behalf of the Consignee and countersigned by a reputable Bank. (Bank Guarantee)
  • The value of the bank guarantee must be equivalent to 200% of the CIF value of the cargo.
  • A copy of the CIF Invoice for the cargo must be submitted together with the LOI & bank guarantee to obtain authorisation for release of the cargo.

Acceptance of LOI’s without a Bank’s countersignature, will only be considered under very exceptional circumstances.

LOI templates for the purpose of release of cargo without presentation of the Original B/L are attached.

* Please note all requests are subject to approval. The processing time for requests to deliver cargo without presentation of original bills is between 1-3 working days from the time full documentation has been received by Swire Shipping and or it's agents.
